ZarMoney is an online accounting software program that stores information about your company and/or an individual that you enter or import. Though we store that information, it is your property. We cannot use or sell your information unless first authorized by you.

Monitoring System Usage: The data that you enter and store in our secure database is password protected and only accessible by you. We only use your collected personal information or data for purposes of updates, purchases of our product or information pertinent to our records. Your data is carefully secured across the Internet. We will never ask for your password nor have knowledge of it, unless you voluntarily share it with us. The only time we will ever access your data is for the purpose of assisting you for technical support.

We will never access the details of any of your financial transactions entered and stored in the service. We will never access the history of system usages for a definitive identifiable user, except through approval by that person to help with a system problem resolution.

ZarMoney staff and key business partners can access non-identifying and accumulated usage information and transaction size in order to better understand how our customers are using the service, so we can improve the system’s design. When pertinent, the system can prompt users with recommendations on ways to increase their own use of our system. All accumulated information usage is gathered in a protected ZarMoney data warehouse facility.

Data is sent securely via the Web. ZarMoney’s servers have SSL Certificates issued by industry-recognized certificate authorities. All data transmitted between users of the service is encrypted. But because the web itself is not a secure environment, users should only enter or instruct the importation of data to the database within a protected environment. It means that your portal must support the encryption guarantee used in connection with this service.

We do not store financial details. Your credit card details are encrypted and securely saved by ZarMoney to automatically bill your credit card on a continuous basis.

We allow automatic bank downloads for your bank accounts through Plaid Data Gathering Service, free of charge. This is via a third party under Plaid Terms of Use. 

Compilation of Financial Institution (Bank) Account Data: You accept that in accessing your financial institution data through ZarMoney online, your financial institution account access number(s), password(s), security question(s) and answer(s), account number(s), login information and any other security or access information and the actual data in your account(s) with such financial(s) such as bank balances, credit card charges, debits and deposits (collectively, “FI Account Data”) may be collected, converted and stored in the ZarMoney service depending upon your financial institution and type of accounts. You permit ZarMoney, in conjunction with ZarMoney’s operation and hosting of the ZarMoney Online service, to (i) collect your FI Account Data, (ii) reformat and manipulate such FI Account Data, (iii) create and provide hypertext links to your financial institutions, (iv) access the financial institutions’ websites under your FI Account Data, (v) and take such other actions as are reasonably necessary to perform the actions described in (i) through (iv). You hereby confirm that you are the legal owner of your FI Account Data and have the authority to appoint and hereby expressly do appoint ZarMoney as your agent with all necessary power and authority to access and retrieve your FI Account Data on your behalf. You further acknowledge that ZarMoney does not review your FI Account Data and agree that ZarMoney is not responsible for its completeness or accuracy. Any transactions or informational activities performed at any financial institution’s website are not made through the ZarMoney’s online service and ZarMoney assumes no responsibility for such transactions or activities. You are solely responsible for any charges associated with your financial institutions.

Information from financial institution websites: You acknowledge and agree that (i) some financial institutions may not allow the ZarMoney service to access your financial data, (ii) financial institutions may make changes to their websites, with or without notice to us, that may affect overall performance of the ZarMoney online service and prevent or delay aggregation of information from such websites and (iii) the ZarMoney service “refreshes” the account data by collecting FI Account Data automatically or manually (depending on your financial institution or any changes by you that may require an update), so your most recent transactions may not always be reflected in any account balances or other account information presented to you in the ZarMoney service. Should you notice a discrepancy in ZarMoney account data, before making any transactions or decisions based on such account information presented in the ZarMoney service, you should check the last refresh date for the account and confirm the ZarMoney account data FI Account Data and manually update such data as necessary.

Your access may also be forever destroyed by ZarMoney 30 days after you stop paying for the service. ZarMoney has the right to destroy your data after 30 days if you have not paid for your account in that amount of time. ZarMoney bears no responsibility or liability for any data that is lost or destroyed under those stipulations.

Your gateway stores no information that will identify your organization: We utilize “cookies” and other technical elements that allow us to monitor traffic patterns to serve you more effortlessly if you visit our site. A cookie does not describe you personally or have any information regarding you or your company, but it will simply identify your company.

We will not sell or grant your personal information to a third party or make any other use of personal information about you for any other purpose, which is not incidental to the normal use of the service.


If you subscribe to a third-party software, it remains your responsibility to check the Privacy Policy of any third-party applications that we link to. We may incorporate links permitting the electronic transfer of the data with third-party applications. ZarMoney takes no responsibility for the privacy methods or content of these applications.

Our privacy policies may be updated periodically. For the most current update, please check back on our website. We will make every attempt to notify you of these changes via email or our website.

Your Data Protection Rights

Under applicable law, and subject to limitations and exceptions provided by law, if you are located in the EEA or UK, and in certain other jurisdictions, you may have certain rights in relation to the End User Information collected about you and how it is used, including the right to:

• Access End User Information collected about you;
• Request that we rectify or update your End User Information that is inaccurate or incomplete;
• Request, under certain circumstances, that we restrict the processing of or erase your End User Information;
• Object to our processing of your End User Information under certain conditions provided by law;

We will provide you with a 15-day trial policy, with no obligation on your part during this period. If you decide to keep this subscription once the trial period has ended, you will be billed immediately upon giving us your billing and payment information.

If you stop paying for your subscription or cancel it, your account will be canceled and your data will be deleted from our system in 30-60 days.

Your agreement with ZarMoney can be on either a monthly or annual basis. We reserve the right to amend the terms at our discretion and will alert you of any changes via email. If you have completed the registration of this software, then you are acting as the authority for the company that you represent, so please read this carefully. By subscribing to the service you agree to our terms, privacy policy and cancellation policy.

We give you non-transferable rights to our services via the Internet, and you determine the user level. You agree not to copy, modify or resell. All services are covered by copyright, trade secret, and other intellectual property laws. You are given only the right to use our services specifically for the purpose listed. We reserve all rights to our services. Until you terminate this agreement and as long as you meet any pertinent payment obligations and adhere to this agreement, ZarMoney permits to you a personal, limited, non-exclusive, non-transferable right and license to use our services on a monthly or annual subscription basis, as determined by you or ZarMoney.

Online Service Use, Storage and Access

ZarMoney shall have authorization in its sole discretion and with acceptable notice posted on our website and/or sent to you at the current administrator’s email address furnished in the Registration Data , to modify, update or otherwise change limits regarding use of the ZarMoney service, temporarily or permanently , including but not limited to (i) the amount of storage capacity you have on the ZarMoney’s service at any time and (ii) the number of times (and the maximum period for which) you may access the ZarMoney service in a given period of time. We reserve the right to make any such changes effective immediately to provide the security of the system or user access information or to adhere to laws or regulations and to furnish you with electronic or written notice within thirty (30) days after such change. You can dismiss changes by suspending use of the ZarMoney service to which such changes relate. Your extended use of the ZarMoney service will establish your approval of and understanding of such changes.

ZarMoney may, from time to time, perform upkeep upon the ZarMoney services. This could result in disruption of services, delays or wrongdoing in the ZarMoney service. ZarMoney will strive to give prior notice of any scheduled upkeep, but cannot warrant that such notice will be furnished.

While ZarMoney targets to make the services available 24 hours per day, seven days per week, it is conceivable that on some occasions the services or our website may be unavailable to allow for maintenance or other improvement activity.

Conditions for Accessing and Using ZarMoney Services

You agree not to use nor allow any third party to use the services to upload, post, distribute, link to publish, reproduce, engage in or transmit any of the following:

1. It is your responsibility to keep all user names and passwords confidential, safe and secure. You must notify us immediately of any unauthorized use or breach of security. We will reset your password, if needed due to forgotten or lost information, after securely confirming your identification. You must take reasonable action to keep the security of our systems and networks intact.
2. Do not sabotage or undermine when any system or network is hosted by a third party.
3. Do not in any way abuse our services in a way that will affect the performance or delivery of the services, website or our other systems or damage the ability of other users to use the services and/or website.
4. Do not attempt to gain unauthorized use to any areas that we host and to which you have not been given permission to access.
5. Do not relay or input any files that may corrupt any other software or devices, that may be in violation of the law (including data or other material protected by copyright or trade secrets that you do not have the right to access).
6. Do not attempt to modify, copy, adapt, reproduce, disassemble, decompile or reverse engineer any computer programs used to transmit the services or to operate the Website, except as is strictly necessary to use either of them for normal operation.
7. Refrain from any illegal, fraudulent, defamatory, obscene, pornographic, profane, threatening, abusive, hateful, harassing, offensive, inappropriate or objectionable information or communications of any kind, including without limitations, conduct that would encourage “flaming” others or criminal or civil liability under any local, state, federal or foreign law.
8. Forums: The service may consist of a community forum, social or other forums to exchange content and information with other users of the services and the public. Please use consideration when you interact with others. Do not divulge information that you do not want to make public. The users can post hypertext links to the content of third parties, for which ZarMoney is not responsible.
9. ZarMoney may candidly use criticism that you provide. You agree that ZarMoney is permitted to use your feedback, suggestions or any ideas in any way, including in future alterations of the services, other products or services, advertising or marketing materials. You permit ZarMoney a perpetual, worldwide fully transferable, sub-licensable, irrevocable, fully paid up, royalty-free license to use the feedback that you provide to us in any way without any payment, recognition or other considerations.
10. ZarMoney may monitor your content. ZarMoney may, but has no commitment to, monitor all content on the services. We may divulge any information needed to satisfy our legal obligations, protect us and our customers or operate the services properly. We, at our exclusive discretion, may post, remove or refuse to remove any content, in whole or part of, alleged to be unacceptable, undesirable, inappropriate or in violation of this agreement.
    
    You use this software on an as-is basis and we cannot be held responsible for it. We do not guarantee that this software will be error-free. You agree to use it on an at-your-own-risk basis. Although this is an accounting software, we are not your accountant and do not offer advice, professional or otherwise. You are responsible to determine if this software fits your needs. We are available to discuss the abilities of this software to meet your expectations prior to subscribing.

Usage Limitation of the Software

Usage of Service may be subject to conditions, included but not limited to monthly transactions and the number of calls you are allowed to make against ZarMoney’s application programming interface. Any such limitations will be specified within the service. As a user, if you dispute any access to this software, ZarMoney reserves the right on what access level from a data or service level that you should have.

You indemnify ZarMoney against all claims, costs, damages and losses arising from your breach of any of these terms or any obligations you may have to ZarMoney, including (but not limited to) any costs relevant to the recovery of any access fees that are due but have not been paid by you.

General: All Intellectual Property Rights, the website and any documentation regarding the services, remain the property of ZarMoney (or its Licensors).

Data Ownership: All Intellectual Property Rights in the data remain your property. Entry to this data, however, is dependent on payment in full for the ZarMoney fee that is due. You give ZarMoney permission to authorize the use, copy, transmit, store and back up your information and data for the purposes of permitting you to access and use our services and for any other determination related to the provision of services to you.

It is your responsibility to keep copies of all your data that is inputted in our system. ZarMoney complies with its best practice policies and procedures to avoid loss of data, including a data system back up procedure but does not make any guarantees nor accept liability for data loss, however, it was caused, under any circumstances.

Third-Party Software and your Data

If you allow third-party software that is being used with our services, you accept that ZarMoney may allow the providers from third parties permission to your data as necessary for the interoperation with our services. ZarMoney shall not be held responsible for any disclosures, modifications or deletions of your data from any such permissions to third party software providers. A person who is not a party to these terms has no authorization to benefit under or to implement all or any portion of these terms.

You are able to use our software with no limitations and unlimited technical support with your subscription. If you have technical issues with the software, you can either call us or email us at: support@ZarMoney.com., and we will reply back to you within 1 business day of receiving this request. If it requires more information, we may either call you or email you.

You also give us the approval to accumulate your non-personal identifiable data, which you enter or upload with that of other users of the services. For example, ZarMoney can use the accumulated data to improve our services, design promotions or provide ways for you to compare business practices with others.

You must provide us with either a bank account from which to debit or a credit or debit card on file for any subscriptions. ZarMoney will bill you automatically with our current rates at the time until you cancel this service. It is your responsibility for all taxes and duties that are added to our fee. If your payment and registration information is not correct, current and complete and you do not disclose to us promptly when this information changes, we may restrict or terminate your account and not allow any use of our service.

Up to 5 gigabytes of data are free. After the first 5 gigabytes, the cost is $1/per gigabyte for data storage per company. (with increments of 10 GB blocks. example: 5 to 15GB will be $10/m)

Disclaimer of Warranties and Acknowledgments

Authority: You guarantee that where you have registered to use our service on behalf of another person, you have the authority to agree to these Terms on behalf of that person and agree that by registering to use the Service that you bind the person on whose behalf you act to the performance of any and all obligations that you become subject to by virtue of these terms without limiting your own personal obligations under these terms.

Acknowledgment

1. ZarMoney has no responsibility to any person, except you. Nothing in this Agreement confers or purports to confer, a benefit on any person other than you. If you use the Services or access the Website on behalf of or for the benefit of anyone other than yourself (whether a body corporate or otherwise) you agree that:
   
   A.You are responsible for ensuring that you have the right to do so.
   B.You are responsible for authorizing any person who is given access to information or data and you agree that ZarMoney has no obligation to provide any person access to such information or data without your authorization and may refer any requests for information to you to address.

5. It is your own responsibility to complete your research of our software and to verify that it meets the needs of your company and that it is sufficient for which it is used for and intended.
   
   
6. You remain exclusively culpable for adhering to all accounting, tax and other laws. You remain culpable to check that storage of and accessibility to your data via our service and website will satisfy with the laws applicable to you (including any laws requiring you to keep records).

No Warranties

ZarMoney gives no guarantee about the services. Without limiting the aforementioned, ZarMoney does not guarantee that the service will meet the requirements or that it will suit your particular purpose. To avoid doubt, all implied conditions or warranties are excluded in so far as is permitted by law, including (without limitation) warranties of merchantability, fitness for purpose, title and non-infringement.



Consumer Guarantees

You permit and represent that you are acquiring the right to access and use the services for the reasons of a business and that, to the maximum extent allowed by law, any statutory consumer guarantees or legislation intended to protect non-business consumers in any jurisdiction do not apply to the supply of the services, the website or these terms.

Limitation of Liability

To the maximum extent allowed by law, ZarMoney makes exclusive all liability and responsibility to you (or any other person that represents you) in contract, tort (including negligence), or otherwise, for any loss (including loss of information, data, profits, and savings) or damage resulting directly or indirectly, from any use of, or reliance on, the service or website.

If you experience a loss or damage, because of ZarMoney’s failure or negligence to adhere with these terms, any claim by you against ZarMoney stemming from ZarMoney’s failure or negligence will be limited in the respect of anyone circumstance or series of connected circumstances to the access fees paid by you in the previous year.

If you are not happy with the service, your one and only solution is to discontinue these terms.

ZarMoney can discontinue, at its own discretion and without any notice given, this agreement or terminate the services, if you do not adhere with our agreement or if you do not permit to receive electronic communications. Upon terminating, you must promptly stop using our services, and any outstanding balances will become due. Any termination of this agreement shall not influence ZarMoney’s rights to any payments due to it. ZarMoney may also cease a free account at its own discretion.

ZarMoney will not provide any refund for any remaining prepaid period for prepaid access fee subscriptions after 90 days.

If payment of any invoice for access fees due in affiliation to any billing of your billing contracts, bill plans or any of your organization is not made in full by the required due date, ZarMoney may suspend or discontinue your use of the service, the jurisdiction for all or any of your organizations to use our service or your rights of access to any or all of the data.

Waiver: If either party foregoes any breach of these terms, this will not constitute a remission of any other breach. No remission will be effective unless made in writing.

No Assignment: You may not authorize or transfer any rights to any other person without ZarMoney’s prior written approval.

Liability: You agree that ZarMoney is not liable in any event for any damages or loss whatsoever for any computer losses due to you using the service. ZarMoney’s liability shall not exceed the fees paid for this service directly or indirectly.

Governing Law and Jurisdiction: If the information or data you are accessing using our services and website is exclusively that of a person who is a taxed resident of the U.S. at the time that you authorize these terms, then the State of California law regulates this agreement and you submit to the exclusive jurisdiction of the state courts of Los Angeles County, California or federal court for the Southern District of California for all conflicts arising out of or in relation to this agreement.

Severability: If any part or provision of these terms are invalid, null or in conflict with the law, that part of the provision is replaced with a provision which, as closely as possible, achieves the original determination of that part or provision. The remainder of this agreement will be binding on the parties.

Notices: Any notice accustomed under these terms by either party to the other must be in writing by email with proof of receipt and will be deemed to have been given on communication. Notices to ZarMoney must be sent to support@ZarMoney.com or to any other email address disclosed by email to you or by ZarMoney. Notices to you will be appointed to the email address that you provided when assembling your access to the service.

Acceptance of the terms: You must be of legal age (18 or over) to enter into this contract. You must agree to all of the above to use our software. Please check that you agree to the terms of this contract.
